Maharashtra is moving closer to becoming the first Indian state with a dedicated law for blockchain-based tokenisation of land and other immovable assets. Speaking at the Global Fintech Fest 2026 in Mumbai on September 9, Chief Minister Devendra Fadnavis said the state is building the architecture for the Maharashtra Digitisation and Exchange of Land Token Asset Act, or DELTA Act.

The objective is larger than putting land records on a blockchain. Maharashtra wants to create a legal structure under which rights connected to physical property can potentially be represented digitally and transacted through tokenised infrastructure.

Fadnavis said Maharashtra is developing the architecture for the DELTA Act to create a legal framework for blockchain-based tokenisation of land and other immovable assets. He said implementation would require collaboration between the Maharashtra government, the Government of India and multiple institutions.

Reports following the Global Fintech Fest announcement indicate that a committee has been formed to review the proposed legislation. Maharashtra expects the law to become the first state-level framework of its kind in India.

Indian property transfers currently involve registered deeds, stamp duty, title verification and government land registries. A token cannot simply replace those legal processes because somebody writes ownership information onto a blockchain.

EtherWorld previously highlighted this problem while examining Maharashtra’s earlier DELTA proposal. The difficult part is connecting the digital token to legally recognised rights over the underlying physical property.

The initiative also continues Maharashtra’s existing interest in blockchain-based public infrastructure. Earlier blockchain experiments in the state have included government records and land-related systems, while India more broadly has increasingly explored distributed-ledger infrastructure for regulated financial activity.

Globally, the trend is already moving in the same direction. Tokenised real-world assets crossed $30 billion in early 2026, with government securities, commodities, funds and private credit becoming major categories.

The DELTA Act Could Turn Property Into Programmable Assets

Selling a property can require weeks or months of paperwork, due diligence, registration and settlement. Raising smaller amounts of capital against that property is equally difficult without taking a conventional loan or transferring an interest through complex corporate structures.

In its simplest form, a property could be represented digitally through blockchain tokens, with each token carrying clearly defined rights connected to the underlying asset. For example, instead of selling an entire commercial property, an owner could theoretically tokenise a portion of its economic value and offer fractional interests to eligible investors.

Indian MP Raghav Chadha previously argued that tokenisation could allow smaller investors to participate in assets that are currently difficult to access. EtherWorld covered his call for an Indian asset tokenisation law, where real estate, infrastructure and other traditionally expensive assets were identified as potential use cases.

That debate later moved into Parliament when Chadha introduced the Asset Tokenisation Regulation Bill, 2026, proposing rules around issuance, trading, custody and investor protection. Maharashtra is now taking a more targeted route by focusing specifically on land and immovable property at the state level.

SEBI, BSE and NSE Bring Regulation Into the Design

The state is working with expertise from SEBI, BSE and NSE, together with industry, technology, legal and academic specialists. That suggests Maharashtra recognises that tokenised real estate could eventually start behaving like a financial product.

If investors can buy fractional interests in property, trade those interests or receive income generated by the underlying asset, regulators may need to determine whether those tokens fall under securities or investment-product rules. Regulators globally are increasingly focusing on the principle that putting an existing financial instrument on blockchain does not necessarily change its regulatory character.

Earlier this year, US banking regulators clarified that tokenised securities should generally receive the same capital treatment as traditional securities. If a token represents a security-like economic interest, SEBI's role becomes increasingly relevant.

Banks are already experimenting with private blockchain settlement and tokenised bank deposits, while institutions increasingly view Ethereum and related blockchain infrastructure as potential settlement layers rather than simply crypto networks. EtherWorld has also tracked how institutions are increasingly taking Ethereum seriously because tokenised assets, stablecoins and onchain settlement are becoming important parts of financial infrastructure.

India Is Moving From Crypto Regulation to Asset Tokenisation

India is simultaneously exploring tokenised corporate bonds, sovereign-linked digital assets and frameworks for tokenised real-world assets. EtherWorld has previously reported on India's proposed sovereign-backed Asset Reserve Certificate, alongside the country's wider debate around asset tokenisation and regulated digital finance.

The shift also comes as India's broader crypto rulebook remains under review. EtherWorld has covered how regulators are examining stronger investor protection, clearer supervision and potentially new regulatory structures in India's evolving crypto framework.

More recently, the debate has extended to whether India could eventually establish a stronger regulatory structure for digital assets through Parliament, as discussed in EtherWorld's analysis of the 2026 Monsoon Session. If the model succeeds, other states could examine similar frameworks covering land, infrastructure or other forms of real-world property.
