The public now has access to a regulated investment instrument that directly holds Bitcoin because of the approval of Switzerland's first spot ETF for individual investors.

The Swiss Financial Market Supervisory Authority, or FINMA, approved and enforced regulations on asset custody, operational risks, and investor disclosures on October 20, 2026. Regular investors now have a new option to invest in Bitcoin through an authorised fund due to the verdict, but the regulator has stressed that there are still serious market risks.

FINMA Approves Switzerland’s First Retail Bitcoin ETF

On October 20, FINMA announced that it had authorised its first exchange-traded retail fund to make direct Bitcoin investments. The fund is classified as other funds for alternative investments with specific risks under Swiss law.

The permission is different from the Bitcoin investment products that are currently offered on Swiss exchanges. Exchange-traded cryptocurrency products have been around for a while, but according to Swiss fund regulations, they are structured as debt instruments rather than investment funds.

The most recent decision broadens access beyond the eligible investors who could previously take part in specific authorised cryptocurrency funds. A fund that invested mostly in a basket of cryptocurrencies was approved by FINMA in 2021, but only eligible investors could purchase it.

The approved fund provider and trading date have not been made public by FINMA. It also verified that proposals for comparable Bitcoin investment products have been submitted or announced by other fund providers.

Bitcoin Gains an Exemption From Diversification Rules

The standard risk diversification requirements that apply to investment funds were waived for the approved fund. Generally speaking, these regulations mandate that funds diversify their investments rather than concentrate their holdings in a particular asset.

FINMA used Bitcoin's very lengthy trading history and exceptionally large trading volume in comparison to other cryptocurrencies to support the exemption. These qualities served as the foundation for permitting the fund to make direct Bitcoin investments without adhering to the customary diversification strategy.

The approved fund and the regulatory evaluation that supported it are the specifics of the exemption. It does not prove that other cryptocurrencies are inherently eligible for the same treatment.

For retail investors, the structure provides access to Bitcoin through a regulated investment fund rather than requiring them to purchase and hold the cryptocurrency directly. However, the approval does not remove the underlying exposure to Bitcoin’s price movements.

Custody Safeguards & Risk Warnings Remain Mandatory

Investor protection is now a key requirement for approval under FINMA. In accordance with the regulator's guidelines released on January 12, 2026, supervised institutions participating in the fund must take steps to lower operational and custody risks.

The risks must also be fully explained in the fund documentation. Under Switzerland's Financial Services Act, companies that sell the product must adhere to conduct regulations, which include giving clear warnings regarding price volatility and the risk of losing money.

Compared to direct bitcoin purchases, these regulations are meant to offer better investor safeguards. Additionally, they hold financial institutions accountable for explaining risks and determining if an investment is appropriate for a client.

FINMA has made clear that regulatory approval should not be mistaken for a guarantee of capital protection. Bitcoin remains highly volatile, and investors using the approved fund could still lose a substantial portion of their invested money.

Bitcoin Trades Near $81,500 as Swiss Access Expands

On October 20, Bitcoin was trading close to $81,500, with minimal movement reported in the wake of the announcement. As a result, there was no significant instant price reaction in the reported market snapshot when the permission arrived.

Rather than any proven short-term shift in Bitcoin's market value, the legislative evolution is important for access. Subject to the product's availability and final launch procedures, Swiss retail investors now have an approved fund structure for direct exposure to Bitcoin.

Switzerland's decision coincides with similar approvals being sought by other fund providers. The volume of applications suggests that asset managers looking to provide Bitcoin investments to the general public may be more interested in the new regulatory approach.

However, the identity of the approved fund provider, its trading date and the availability of the product to individual investors remain details to watch. FINMA’s announcement confirms the regulatory approval, while leaving those commercial arrangements undisclosed.
